1. Acceptance of terms
These Terms & Conditions ("Terms") govern your access to and use of the Zilter website and the Zilter DTS platform (together, the "Service"), provided by Zilter Technologies Limited, trading as "Zilter" ("Zilter", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Accounts & eligibility
To use Zilter DTS, you or your organization must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account.
3. Subscriptions & payment
Zilter DTS is offered under paid subscription plans. Fees, billing frequency, and plan features are as described at the time of purchase or as agreed in a separate order form. Payments are processed securely through our payment provider. Unless otherwise agreed in writing, fees are non-refundable and subscriptions renew automatically until cancelled.
4. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service; interfere with or disrupt the integrity or performance of the Service; upload malicious code; or use the Service to send unsolicited communications in violation of applicable law.
5. Your data & content
You retain ownership of all student, applicant, and business data you submit to the Service ("Customer Data"). You grant Zilter a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and consents to submit Customer Data, including personal data relating to students and applicants, in compliance with applicable data protection law. 6. Intellectual property
The Service, including its software, design, branding, and content (excluding Customer Data), is owned by Zilter and protected by intellectual property laws. Nothing in these Terms grants you any right to use Zilter's trademarks or branding without our prior written consent.
7. Third-party services
The Service may integrate with third-party services (such as Google, Microsoft, WhatsApp, Stripe, and cloud infrastructure providers). Your use of those third-party services is subject to their own terms and privacy policies, and Zilter is not responsible for their performance or availability.
8. Availability & support
We aim to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance or updates from time to time. Support is provided in line with your subscription plan.
9. Termination
You may cancel your subscription at any time in accordance with your plan terms. We may suspend or terminate your access to the Service if you breach these Terms, or for non-payment, after reasonable notice where practicable.
10. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law.
11. Limitation of liability
To the maximum extent permitted by law, Zilter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service.
12. Governing law
These Terms are governed by the laws applicable in the jurisdiction in which Zilter Technologies Limited is registered, without regard to conflict of law principles.
13. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated to active subscribers, and continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
